In a decision of 6-3 Justices Roberts and Kennedy, who many felt were the deciding votes, voted to uphold the key provision in the ACA brought on by King v Burwell. The key question centered on whether federal subsidies would be allowed in states that did not set up their own exchange. More than 6 million Americans were receiving subsidized healthcare in states that did not set up their own exchange.
